Cause
After the failure of the KEI Programme , the judiciary reconsidered digital litigation. This led to the Basic Plan for Digitization of Civil and Administrative Law ('Basic Plan'). The Basic Plan has the apt subtitle 'reset digitization KEI'.
Basic plan for digitization of civil and administrative law
The Basic Plan must become a new solution for digital litigation in the areas of civil law and administrative law.
Project Digital Access
A consequence of the Basic Plan is the Digital Access Project. This project should lead to a digital letterbox for litigants, a digital mailroom for court registries and a digital file for litigants for all types of civil and administrative cases. In view of the experiences with the KEI Programme, small steps are being taken.
It was quiet for a long time. But today the Judiciary announced that, at least for civil law, the first small step is being taken. The first concrete application of the Digital Access Project will start shortly and concerns a digital portal for submitting attachment claims.
Submit a pilot digital attachment claims
This digital portal for submitting attachment claims is a pilot that will start at the Amsterdam court from 28 June 2021. Participation is voluntary for the time being.
Little else is known about the pilot. Only that you have to log in with your lawyer's card viasrecht.nl, that lawyers can upload documents in this portal (in PDF format) and communicate with the court. Furthermore, the lawyer automatically receives “a digital confirmation of receipt” for their file (I assume an e-mail).
A manual will be available online at the end of this month and hopefully more will be known about the operation and functionalities.
The pilot will last six weeks and if the evaluation is positive, lawyers will be able to digitally submit an attachment application to all courts this autumn.
Next pilot
According to an earlier press release , the next step in the digitization process is “the case flow of state taxes” at the Arnhem-Leeuwarden Court of Appeal.
