Court fees 2021: what will change?


What is court registry

The court fees will change in 2021. Court fees (also known as standing charges) are the costs that a party to the proceedings must pay at the start of the proceedings. If you do not pay the court fee or do not pay it on time, there is a chance that the court will not consider your request or claim.

When is / is not a court fee?

For civil (civil) cases, the Civil Cases Act ('Wgbz') regulates when someone does and when does not have to pay a court fee. Not everyone owes a court fee.

Court fees 2021

This year, too, the court fees will be indexed by +1.69%. This is equal to the increase in the consumer price index in the period July 31, 2019 to July 31, 2020.

This means that the rates for 2021 will read as follows:

Amendment Wgbz in 2021

The above categorization is expected to change in 2021. The aim is to introduce additional categories for claims between €500 and €12,5000. A bill for this is pending in the House of Representatives. [1]

An amendment is also pending to introduce a category for claims over €1,000,000 with a court fee of €11,034 for non-natural persons, €1,727 for natural persons and €332 for incompetent persons. [2]

Minister Dekker's bill has been criticized (see, for example, here , here and here ) and the near future will show what the new court fee system will look like.
